Service Agreement for Done-For-You Agency Program

Agreement of Terms and Conditions Between SobeViral LLC (Referred to as “Service Provider” in further text) And the purchaser (Referred to as “Client” in further text) "Client", and SobeViral, "Service Provider", functioning in the capacity of an Independent Contractor, for Consulting Services to be rendered by Service Provider for Client.

Collective, the Agency and the Client are referred to as "Parties."

The purpose of this Agreement is to clarify consulting and services provided by Service Provider for Client.

 

1. Services Provided.

Service Provider agrees to provide the following services for Client with the purpose of building and growing their own consulting business:

1. Done-For-You training program at the Starter - Level.
2. Lifetime access to the online Done-For-You agency portal with all of the training videos, funnels, and downloadable documents.
3. Email support to assist Client with any questions/issues.
4. 3 pre-built agency lead generating funnels on Clickfunnels
5. Ability to upgrade to the Coached or Elite levels by only paying the difference in the current package pricing.

 

2. Payment.

For compensation of Service Provider’s performance of these services, the Client agrees to pay Service Provider the mutually agreed upon price of _$1497__.

 

3. Expectations.

Work will commence after receipt by Service Provider of the agreed upon payment.

• Client understands that the information given by Service Provider is strictly for educational purposes. Therefore, if you wish to apply (or not apply) ideas given, you are taking full responsibility for your actions.

 

• As with any business agreement, there are risks involved. Lead generation is not fool-proof and more leads will not help if the business fundamentals are essentially flawed. Individual results will always vary and depends entirely on the Client‘s capacity, work ethic, business skills, level of motivation, the state of the economy, normal and unforeseen risks of doing business, and various other factors.

 

• With some Clients results can arrive substantially sooner. The Client understands that it takes drive, perseverance, patience and a reasonable amount of resources to attain desired results. The Client agrees that SobeViral LLC or any of its employees or contractors are not liable to the Client in any way for the Client’s results in using the products and services provided by the Service Provider.

 

4. Client Responsibility.

Client will put forth reasonable effort to achieve the action items they set for themselves with Service Provider.

 

5. Terms of Sale.

You hereby ratify your understanding that all services and training provided must be implemented in full before a refund can be requested. By signing this agreement you waive any rights to charge-back your purchase with your credit card processor.

Client and Service Provider are in agreement that circumstances or conditions sometimes arise that warrant or necessitate termination of the Client-Service Provider working relationship. In view of this possibility, both Client and Service Provider agree that should the relationship terminate, it will be done so in an amicable fashion, maintaining an attitude of cooperation and professional demeanor, with respect for the reputation and dignity of the other party.

If notice of termination is given by either Client or Service Provider, no new work shall be initiated, but any work previously authorized by Client up to the point of receipt by Service Provider or Client of termination notice shall be completed.

 

6. Refund Policy and 100% Money Back Guarantee.

SobeViral will provide a full refund, upon completion of the 6-week program only if the client has implemented all elements of the program and is not satisfied. All outstanding payments must be paid in full for a refund to be issued.

 

Requirements for a Refund Request:

For a refund to be requested, you must be able to prove the following items have been implemented.

For Coached and Elite clients:

• The client must have attended all coaching sessions

For Starter, Coached, and Elite level clients:

• The client must have customized and tested at least 2 of the 3 funnels provided in the program, or tested a custom funnel built for you
• The client must have tested a minimum of 5 audiences in Facebook ads
• The client must have spent at minimum of 2K USD in Facebook ads testing your audiences and funnels.
• The client must have contacted a least 3 digital marketing contractors who bring additional case studies to your agency.
• The client must have at least 5 recorded sales calls with prospective clients.
• The client must have implemented the 5 non-funnel agency lead generators taught in the program including LinkedIn and cold email targeting.

 

7. Release of Liability.

In consideration of my participation in the program, I, my heirs, legatees, assigns, agents, officers, directors, shareholders and co-workers I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE, SobeViral, heirs, assigns, agents, officers, directors, and shareholders, assistant instructors, experts, and teachers, from any and all claims, demands, or causes of action arising from my participation in this agreement.

 

8. Legal Venue.

Any disputes arising from this Agreement will be litigated or arbitrated in Broward County, FL, USA. This Agreement shall be governed in accordance with the laws of the State of Florida, USA.

 

9. Mutual Indemnification

Both parties will, at their own expense, defend, indemnify, and hold the other, its agents, and employees harmless from any and all claims, actions, liabilities, injuries, damages, losses, grants, costs, and expenses, including attorney fees, arising out of or in connection with any use of the Program(s) of this Agreement.

 

10. Client Requirements.

The client is of legal age, competence, and intends to be legally bound by this Agreement. I have read this document and fully understand everything in it.
